    Abstract

    This case note deals with private prosecutions. Notably, through an analysis of the case of R (Morjaria) v Westminster Magistrates’ Court, the case note explores the issues arising where a private prosecution is sought for reasons other than in the interests of justice, with reference to the power of the Magistrates' Court to stay such proceedings as an abuse of process.
